PREREQUISITES:
The course is an introduction to legal systems of the Germanic legal tradition, particularly to the German legal system, but also to that of Austria and Switzerland. The course is held in Italian and will be complemented with periodical optional seminars in German. Attendance of the course of legal German language held by Dr. Bettoni is recommended

PROGRAMME:
The course is intended only for attending students and deals with basic notions of private and public law, but aims generally at transmitting the peculiarity of the legal thought of the Germanic legal tradition, concentrating on Germany. Periodical practices will analyse specific topics and favour active participation of students. Particular attention will be devoted to legal research.
Structure
The course is divided in two parts. Prof. Udo Reifner and Dr. Luca Nogler will hold the first part, devoted to private law.  Attention will be paid to the origins and elaborations of the Civil Codes, focusing then on obligations. The second part, devoted to public law, will be held by Dr. Jens Woelk. In the part related to constitutional law, fundamental rights and organization of the State will be analysed, with a special stress on the federal system. Another part will deal with the basic notions of administrative law.

ASSESSMENT METHOD:
The exam will be in the summer session. Attending students can take the exam in two parts, the first in the last week of the lectures on private law, while the second, concerning public law, will be immediately after the end of the course.
 

SUGGESTED READINGS:
For the part concerning private law, we suggest U. REIFNER, Vertragsrecht, Trento, 2000, whose Italian translation will be provided. We advise in any case the following text L. RAISER, Il compito del diritto privato, Giuffrè, Milano 1990. Beside papers given on public law during the lectures, we report A. ANZON / J. LUTHER (trad.), La legge fondamentale tedesca.
